Description:
In 2002, a new Article 12 was added to the official text of the Uniform Commercial Code. The new article governs the holding and transfer of digital assets, called "controllable electronic records" in the article, and conforming amendments to Article 9 govern the use of these assets as collateral for obligations. Although Texas has not yet enacted these provisions, many states have done so because of choice-of-law issues Texas practitioners need to understand them.
